Dar court orders Ugandan rebel leader extradited, accused appeals decision

The ruling was given by the Principal Resident Magistrate, Cyprian Mkeha.
Mkeha issued the ruling saying he was satisfied that Mukulu is
charged with a murder case in his country and the charge was not
politically motivated.
“Having being satisfied with the supplementary information and
evidence filed, this court is contends that the respondent is wanted by
the Republic of Uganda for murder charges,” said Mkeha.
However Mkulu’s advocate Martin Rwehumbiza said his client will
appeal the ruling; “I humbly request this honourable court that my
client be returned to custody while I wait my appeal application to be
processed,” he urged.
The court agreed and ordered Mukulu be remanded pending his appeal
process and guaranteed the respondent a fair trial before being
extradited to Uganda.
Magistrate Mkeha ordered that Mukulu be furnished with all the case’s proceedings so that he can process his appeal.
The application of the arrest warrant was issued by a Resident
Magistrate Court in Jinja Uganda, an affidavit from the Attorney General
of Uganda, an affidavit sworn by the police in Uganda, showing that
Mukulu is wanted in his country not for political grounds according to
the charge sheet.
“In the additional information issued at the court, showed that the
Director of Public Prosecution of Uganda on June 15, this year had
applied for the name of Mukulu to be removed in other charges of
aggravated robbery and attempted murder in the charge sheet containing
22 charges among which 7 charges were of murder,” he said.
