The Kisutu Resident Magistrate’s Court yesterday adjourned the preliminary hearing of a case facing six former National Service, (JKT) servicemen accused of conspiracy, unlawful assembly and incitement.
The prosecution, led by State Attorney Genes Tesha, claimed before
Senior Resident Magistrate Frank Moshi that yesterday the case came up
for preliminary hearing but the case file was not available.
Therefore the court set May 7 for conducting the preliminary hearing.
The accused in the case are George Mgoba, Linus Steven, Paral Kiwango, Emmanuel Mwasyembe, Ridhiwani Ngowi and Jacob Mang’wita.
They appeared before the court for the first time on February 24
this year charged with three counts, including that of unlawful
assembly.
They are still in custody following an objection by the Director of Public Prosecution (DPP).
It was alleged that on February 15 this year at Msimbazi Centre, the accused conspired to commit an offence of rioting.
It was further alleged that, on the same day and place, the accused
being ex-trainees of the National Service unlawfully assembled with the
intention of marching to the President’s Office (State House) to
forcefully demand employment in the public service.
According to the prosecution, their intention could provoke other people to commit a breach of peace.
However, Mgoba, Steven and Kiwango are also jointly charged with
inciting the ex-trainees to conduct an illegal demonstration to the
President’s Office.
