A 92 year old man, Peter Chacha, yesterday appeared
before the Kisutu Resident Magistrates’ Court in Dar es Salaam charged
with three counts including one of forgery.
The Prosecution led by State Attorney Diana Lukondo assisted by
State Attorney Ofmedy Mtenga alleged that the accused, a resident of
Bonyokwa in Dar es Salaam, committed the first offence between December
2009 and June 2013.
Before Senior Resident Magistrate Walialwande Lema, the prosecution
alleged that the accused being a member of Tanzania Legion and Clubs
forged minutes of the club meeting dated December 8, 2009.
According to the prosecution, the accused forged the minutes purporting to show that he was the chairman of the said club.
Lukindo further alleged that on the same day, the accused with intent to defraud represented himself as chairperson of the club.
It was further alleged that on June 17, 2010 at Salender Bridge
Police Station, the accused made a lose report claiming two lands plot
number 1082 with title number 58138 located at Upanga and plot number
1983 with title number 100328 located at Bonyokwa, Kinyerezi purporting
that both being the property of the Club had been lost.
The prosecution alleged that the accused also knew that the
documents were not lost and that the information he was submitting was
false.
The prosecution further alleged that on an unknown date and month
in 2012, within the City, the accused made a declaration that the
certificate of the title of the two plots had been lost, the fact he
knew to be false.
The accused pleaded not guilty to the charges and was remanded
after failing to meet bail conditions. The court ordered the accused to
bring two sureties who would sign a bond of one million each.
According to the prosecution the investigation into the court is
not complete and asked the court to set a date for another mention. The
case was adjourned to April 14 this year.
